While 2012 maybe a quiet year for legislation affecting associations because of partisan politics, CLAC reports that they have been ‘put on notice’ that legislation will be introduced in 2013 to level the playing field between homeowners and associations. The issue according to the unnamed legislator is that homeowners don’t have a viable way to enforce those provisions in CCIOA designed to protect them, without protracted litigation.

Apparently some of the solutions being considered are:

  1. mandatory mediation;
  2. an ombudsman to advocate for owners;
  3. expedited court procedures for cases to enforce certain sections of CCIOA.
