We all know that smoking and specifically second hand smoke is controversial.  Over the years we have seen local and statewide restrictions on smoking in most public places, some specifically related to multi-family communities and at least one Colorado court has upheld a declaration amendment prohibiting smoking IN units. But, HB 3253 introduced in the Massachusetts legislature this year, may be a sign of the “next” level of second hand smoke regulations. The proposed bill prohibits smoking in multi-family residences including all residences everything except single family residences.  Do you think more or less legislation is needed regarding second or even third hand smoke?
