A new law which goes into effect on November 22, 2012, in Santa Monica, California prohibits all new owners or residents of multi-unit housing from smoking within their unit.  The law states that condominium associations must complete a smoking survey of their current residents where owners will be required to designate their units as either “smoking”  or “non-smoking”.  Current unit owners or residents will be allowed to continue smoking within their units only if their units are designated as “smoking” units.  Is this the wave of the future?  Will laws like this come to Colorado?  Colorado currently has local and statewide restrictions on smoking in public spaces, some which are specifically related to condominium or townhome communities and at least one Colorado court decision has upheld an amendment which prohibits smoking inside of units.
