Get ready for more legislation affecting community associations. We have long speculated that the new law requiring associations to register with the state, will be a conduit for legislation. Last Thursday’s Aurora Sentinel article confirms it. Representative Su Ryden from Aurora is quoted saying “We can gather the information and data and start seeing if there are any trends, certain trouble areas, of if there are places that need legislation.” So what constitutes a trend? 5 complaints about associations not following their bylaws? 12? 1500? As an industry it is your responsibility to educate, advocate and motivate board members and managers to follow the governing documents, follow Colorado law and afford owners within communities the opportunity to be involved in the democratic process which is inherent in every community association.
