We all know that the issue of illegal workers in the US has been a hot issue over the last several years and many states, including Colorado, have adopted laws to curb employment of illegals. As of October 1, 2012, all Colorado employers must use the Colorado Division of Labor Affirmation Form to make the following affirmations within 20 days of hiring a new employee for work in Colorado:
- The employer has examined the legal work status of the new employee;
- The employer has retained file copies of the documents required by 8 U.S.C. Section 1324(a) which is commonly referred to as the Form I-9;
- The employer has not altered or falsified these documents;
- The employer has not knowingly hired an illegal alien.
