In a “sweep” done by the Missouri Department of Natural Resources many associations have been cited for environmental violations that could lead to contamination of water sources within the State.  In some situations the cases were referred to the state’s Attorney General because of the seriousness of the violation.  The associations who were cited operate wastewater treatment facilities that utilize septic tanks.  Violations ranged from failing to submit discharge reports, to letting permits lapse to not having functional disinfection systems.

If your association operates a wastewater treatment facility, a water system or is responsible for bodies of water within the community that drain into public areas your board should understand the local, state and federal requirements for operation, maintenance, permitting, etc.  The best place to start would be the Colorado Department of Natural Resources, Division of Water Resources or you can contact one of our attorneys.
