The Colorado Civil Rights Division (“CCRD”) has determined that it will take further action to investigate claims of racial discrimination made by residents of a local mobile home park. The allegations are that the managers are towing cars owned by residents of Mexican descent while ignoring similarly inoperable cars owned by other residents of non-Mexican descent. The CCRD has not yet made a final determination on this matter but this is an important reminder of the need to enforce covenants equally against all members of your association. Even the unintentional appearance of racial discrimination could lead to a similar complaint filed by a minority owner. Defense of a claim filed with the CCRD can be costly, time consuming and a deterrent to would be homebuyers. You will always have a solid defense to complaints of discrimination if you make equal enforcement a priority in your community.
