As reported by the Denver Business Journal yesterday, a federal judge in New York ruled that a company violated state and federal wage laws by using unpaid interns.  Although governmental agencies and nonprofit organizations appear exempt from the ruling, for-profit businesses should use caution when using unpaid interns, even interns who are receiving college credit in connection with the internship.

Given the ruling, all employers are advised to consult with legal counsel to discuss the applicability of state and federal minimum wage laws prior to utilizing unpaid interns.  If you would like more information regarding employment issues facing your company, please contact our Business Law Group partner, David A.
