Most boards are clear on the concept that associations manage the common elements, but what does that mean and are there any limitations? Do owners have any say in what associations do with common elements? For example, do boards have authority to sell common elements or close them indefinitely? What about removing tennis courts and replacing them with playground equipment?
On top of that, governing documents are not usually very clear when it comes to maintenance and repair obligations. But sometimes, these obligations appear to be fairly straight forward. However, it is precisely those types of provisions that can get associations in trouble. For example, boards oftentimes believe they know exactly who is responsible for unit repairs when such unit suffered damage due to leaking pipes; other times, landscaping obligations for front yards of townhomes seem fairly clear. But these are just two out of many, scenarios that oftentimes lead legal troubles.
This class will examine these issues and other scenarios with respect to management of the common elements and problematic maintenance scenarios that tend to throw monkey wrenches into board obligations even though they can seem straightforward.
