If an association cannot gain voluntary compliance from an owner when it comes to violations, it will likely end up initiating legal action against the violating owner to gain compliance judicially. Unfortunately, however, anytime an association utilizes the court system to enforce its covenants, it leaves the ultimate decision in the hands of a judge who doesn’t live in the community and has no knowledge of the community.   For this reason, it is important to know what the judges look at and consider when making their decisions.  In this class, we will discuss the trends we are seeing in the courtrooms when it comes to covenant enforcement cases and what those trends may mean to your community and its enforcement efforts.
