When properly drafted, rules are a useful tool for community associations. Rules are intended to set forth various restrictions and requirements when it comes to behavior in communities. But sometimes, boards unknowingly adopt rules that are not enforceable and, oftentimes, expose the association to liability. Other times, boards can be a bit overzealous and adopt rules that they simply have no legal authority to impose or that result in political consequences. This leads to distrust of boards by owners and sometimes, legal action against the associations. This presentation will discuss the most common mistakes when it comes to drafting rules and how to avoid them.
