If you live in an association it is critical for you to know the difference between the powers and duties of the board vs. the powers and duties of the homeowner. Although the board is typically made up of volunteer homeowners, once a homeowner is elected onto the board he or she must take off their homeowner hat and put on their board member hat, as the roles are very different. A board member’s role is quite elevated and encompasses numerous powers and duties, some of which are contained in the governing documents, some in various statutes. Regardless of where they originate, boards must know them, adhere to them, and exercise them properly to best serve the association and to minimize liability exposure.
Homeowners, too, must know and understand the obligations that come with living in a community association. Quite a few homeowners purchase property in an association without knowing their rights and responsibilities as a member of a nonprofit corporation. Additionally, many homeowners don’t realize that the board’s authority is limited in certain respects, and homeowner approval must be obtained before the board performs certain actions.
Please join us for this class, where we will identify the various homeowner and board duties and obligations, discuss what they mean and how you can comply. This session is a great educational tool for new board members and new owners, and it is an excellent refresher for experienced directors and owners too!
