Boards often ask about banning smoking, hoarding, or other activities inside units believed to be “bad” for their communities. Much of the time, the answer depends on the language contained in their governing documents, but oftentimes there are other factors to consider. For example, it is important to be aware of court cases (whether in Colorado or elsewhere) that may exist addressing such regulations. Additionally, there may be a higher owner approval requirement for declaration amendments that attempt to regulate certain activities inside units. This class will examine some of the most common attempts at regulating what owners and residents do inside their units and discuss whether such attempts are lawful, and if so, what is required.
