Halloween is afoot and so are all the decorations that come with the holidays. Although most communities tolerate decorations in moderation, what do you do when the Grizwold’s move into your community and light up their entire house and yard with lights, puking pumpkins, screaming goblins, magical reindeer and a flashing Santa that are so bright, the neighbors have to keep their blinds closed to keep their sanity? You don’t want to be a Grinch or be accused of discriminating, so how can an association enforce its covenants in a lawful, nondiscriminatory, and non-Grinchy fashion to avoid these types of claims? This session will also focus on drafting enforceable rules when it comes to holiday, and other exterior decor.
